This agreement is between you and Australia On Line (ACN 064 289 925) trading as Lizzy Internet
By using services provided by Lizzy Internet you are committing to this agreement.
PRIVACY - Lizzy Internet will not provide your details to any third party unless required to do so at the request of a court or pursuant to law enforcement.
TELEPHONE COSTS - Telephone costs to connect to Lizzy Internet are your reponsibility and we urge you to check with your telephone company that the telephone number you use to access the Internet via Lizzy Internet is a local call for you.
You agree to purchase this plan until such time as you cancel at the web address www.cancel.lizzy.com.au.
You will be charged in advance up until the end of the current full calendar month or the end of the first full calendar month.
Fees are calculated pro-rata so that if you join part way through a month you will only pay for that part of the month that remains and the next full calendar month. Thereafter you will only pay 1 calendar month at a time.
Any fees paid in advance are not refundable unless a 30 day money back guarantee is in force for the particular service and you are requesting such a refund within the first 30 days of you being registered with Lizzy Internet
You are paying for the entitlement to use the service and that the service has been made available to them. Consequently the Customer is obliged to pay for the service until the end of the calendar month in which they cancel, whether they have made use of the service or not.
This plan is only for one modem connection at any one time.
You agree to indemnify Lizzy Internet and hold Lizzy Internet harmless for any damages whatsoever to yourself or to any third party/s as a result of your use of any service provided by Lizzy Internet to you.
You agree that you are connecting to an insecure public network (the internet) via Lizzy Internet and you acknowledge that Lizzy Internet is not responsible for any losses or damage that you may experience as a consequence of you connecting to the Internet.
You agree that you are responsible for ensuring the security of your own computer systems and acknowledge that Lizzy Internet is not responsible for preventing attacks upon your systems and Lizzy Internet is not responsible for preventing the transmission of malevolent code such as viruses to your computers even when such attacks occur via Lizzy Internet's network.
You agree to indemnify Lizzy Internet and hold Lizzy Internet harmless for any damages whatsoever to yourself or to any third party/s as a result of your use of any service provided by Lizzy Internet to you.
You acknowledge Lizzy Internet does not and can not exercise control over what content is accessible via the Internet and hence via Lizzy Internet s network and you acknowledge that there is content accessible on the Internet which is unsuitable for children.
Lizzy Internet may terminate this agreement at any time without notice to you without incuring any liability or damages, either direct or indirect whatsover as a result.
In particular Lizzy Internet may terminate this agreement immediately for reasons that include, but are not limited to, where Lizzy Internet has reason to believe that you are violating a third party's copyright or you are sending unsolicited email or using the service for illegal purposes.
Lizzy Internet will not be liable for any disruption or interruption to the provision of this service. Where this limitation of Lizzy Internet s liability is held to be invalid, Lizzy Internet s liability will be restricted to the resupply of the service.
Lizzy Internet will maintain records of your usage for the purposes of billing and determining whether the service is used for the purposes of diseminating viruses or disseminating unsolicited bulk email (spam).
Lizzy Internet may send you electronic and non-electronic correspondence from time to time to make you aware of additional services Lizzy Internet is providing
Lizzy Internet may vary this agreement from time to time and will make the amended agreement available on our website.
This agreement shall be governed by the law in the State of Victoria, Australia.
